Terms of Service

These terms are the agreement between you and Basketball Mind, the publisher of the app. Who we are is described in section 1 of our Privacy Policy.

1. What Basketball Mind Is

Basketball Mind is a mental skills training app for basketball players. It offers guided audio exercises, a mental-skills self-assessment, training programs, a journal and progress tracking (XP, levels, streaks and badges).

What Basketball Mind Is Not

Basketball Mind is not a medical device, not therapy and not a substitute for professional mental health care. The app offers training and educational content based on sport psychology research. It does not diagnose, treat or cure any condition.

If you are in crisis or thinking about harming yourself, contact help right away:

  • Netherlands: 113 Zelfmoordpreventie, call 113 or 0800-0113 (free), or chat at 113.nl
  • United States: 988 Suicide & Crisis Lifeline, call or text 988
  • Elsewhere in the EU: 116 123 (emotional support line in many EU countries)
  • Immediate danger: call your local emergency number (112 in the EU, 911 in the US)

Do not rely on Basketball Mind in an emergency. The app does not monitor how you are doing and cannot respond to a crisis.

2. Accepting These Terms

By using Basketball Mind you agree to these terms. Our Privacy Policy explains how we handle your data. If you do not agree, do not use the app.

You must be at least 13 years old to use Basketball Mind. If you are under 16, ask a parent or guardian before you create an account. If you are under 18, a parent or guardian should know that you use the app.

3. Your Account

  • An account is optional. You can use the app without one; your data then stays on your device.
  • If you create an account, keep your password safe and do not share your account.
  • You are responsible for what happens under your account.
  • Version 1.0 has no automatic password reset. If you lose access, email us.
  • Tell us at legal@basketball-mind.com if you think someone else is using your account.

4. Price

Basketball Mind version 1.0 is free. There are no paid features, subscriptions, in-app purchases or ads.

If we ever add paid features, we will tell you in advance, show the price before you buy, and update these terms. You will never be charged without choosing to buy something.

5. Acceptable Use

Use Basketball Mind in good faith. Do not:

  • share your account or use someone else's account;
  • try to access other users' data or disrupt our servers;
  • use bots or scripts to scrape or overload the service;
  • reverse-engineer the app, except where the law allows it;
  • give false information about your age;
  • use the app in a way that breaks the law.

We may suspend or close accounts that break these rules.

6. Intellectual Property

Our Content

The exercises, scripts, audio recordings, illustrations, design and texts in Basketball Mind belong to Basketball Mind or its licensors and are protected by copyright. You may use them for your own training. Do not copy, share or sell them without written permission.

Your Content

What you write in the app (journal entries, notes, goals) is yours. In version 1.0 your journal entries stay on your device and are not sent to us.

7. Mental Health Disclaimer

Basketball Mind is a mental performance training tool, not a mental health service.

  • The app does not provide therapy, counselling or clinical psychological care.
  • The content is meant to improve performance, not to treat a condition.
  • The app does not monitor your wellbeing and cannot tell if you are in distress.
  • If an exercise or any content makes you feel worse, stop and talk to someone you trust or a qualified professional.

The crisis button in the app and the help lines in section 1 are always available.

8. Limitation of Liability

To the extent the law allows:

  • Basketball Mind is provided "as is", without guarantees that it will work without interruption or errors, or that it will help you reach specific performance goals.
  • We are not liable for indirect or consequential damage resulting from using the app.
  • We are not responsible for decisions you make based on the app's content.

Nothing in these terms limits liability that cannot be limited by law, such as liability for intent or gross negligence, and nothing limits your rights as a consumer.

9. Availability and Changes

  • We try to keep Basketball Mind available but cannot promise it will always work. Maintenance and problems can cause downtime.
  • We may add, change or remove features.
  • We may update these terms. We will change the date at the top, and tell you in the app about important changes. If you do not agree with new terms, you can stop using the app and delete your account.

10. Ending Your Use

By You

You can stop at any time. To delete your account, go to Profile → Delete Account in the app. Your account and its data are deleted from our server permanently and right away, and the data on your device is cleared. You can also email privacy@basketball-mind.com. See our Privacy Policy for details.

By Us

We may suspend or close your account if you break these terms, if your use puts the service or other users at risk, or if the law requires it. Where possible, we will tell you first.

11. Governing Law and Disputes

These terms are governed by Dutch law. If you are a consumer, you keep the protection of the mandatory consumer law of the country where you live.

If you have a complaint, please email us first; we will try to solve it together. Disputes go to the competent court in the Netherlands, unless the law gives you the right to go to a court where you live.

12. Severability

If a part of these terms is not valid, the rest still applies.

1. Wat Basketball Mind is

Basketball Mind is een app voor mentale training voor basketballers. De app biedt begeleide audio-oefeningen, een zelfassessment van mentale vaardigheden, trainingsprogramma's, een dagboek en voortgang (XP, levels, streaks en badges).

Wat Basketball Mind niet is

Basketball Mind is geen medisch hulpmiddel, geen therapie en geen vervanging van professionele geestelijke gezondheidszorg. De app biedt training en uitleg op basis van onderzoek in de sportpsychologie. De app stelt geen diagnoses en behandelt of geneest geen aandoeningen.

Zit je in een crisis of denk je eraan jezelf iets aan te doen, zoek dan meteen hulp:

  • Nederland: 113 Zelfmoordpreventie, bel 113 of 0800-0113 (gratis), of chat via 113.nl
  • Verenigde Staten: 988 Suicide & Crisis Lifeline, bel of sms 988
  • Elders in de EU: 116 123 (hulplijn voor emotionele steun in veel EU-landen)
  • Direct gevaar: bel het alarmnummer (112 in de EU, 911 in de VS)

Vertrouw in een noodsituatie niet op Basketball Mind. De app houdt niet bij hoe het met je gaat en kan niet reageren op een crisis.

2. Deze voorwaarden accepteren

Door Basketball Mind te gebruiken ga je akkoord met deze voorwaarden. Ons privacybeleid legt uit hoe wij met je gegevens omgaan. Ga je niet akkoord, gebruik de app dan niet.

Je moet minstens 13 jaar zijn om Basketball Mind te gebruiken. Ben je jonger dan 16, vraag dan een ouder of voogd voordat je een account maakt. Ben je jonger dan 18, dan hoort een ouder of voogd te weten dat je de app gebruikt.

3. Je account

  • Een account is optioneel. Je kunt de app zonder account gebruiken; je gegevens blijven dan op je apparaat.
  • Maak je een account, houd je wachtwoord dan geheim en deel je account niet.
  • Je bent verantwoordelijk voor wat er onder je account gebeurt.
  • Versie 1.0 heeft geen automatisch wachtwoordherstel. Kom je er niet meer in, mail ons dan.
  • Laat het ons weten via legal@basketball-mind.com als je denkt dat iemand anders je account gebruikt.

4. Prijs

Basketball Mind versie 1.0 is gratis. Er zijn geen betaalde functies, abonnementen, in-app-aankopen of advertenties.

Voegen wij ooit betaalde functies toe, dan laten wij dat vooraf weten, tonen wij de prijs voordat je iets koopt en passen wij deze voorwaarden aan. Je betaalt nooit iets zonder dat je zelf kiest om iets te kopen.

5. Toegestaan gebruik

Gebruik Basketball Mind te goeder trouw. Het is niet toegestaan om:

  • je account te delen of het account van iemand anders te gebruiken;
  • te proberen bij gegevens van andere gebruikers te komen of onze servers te verstoren;
  • bots of scripts te gebruiken om de dienst te scrapen of te overbelasten;
  • de app te reverse-engineeren, behalve waar de wet dat toestaat;
  • een onjuiste leeftijd op te geven;
  • de app te gebruiken op een manier die de wet overtreedt.

Wij kunnen accounts die deze regels breken blokkeren of sluiten.

6. Intellectueel eigendom

Onze inhoud

De oefeningen, scripts, audio-opnames, illustraties, het ontwerp en de teksten in Basketball Mind zijn van Basketball Mind of haar licentiegevers en zijn beschermd door het auteursrecht. Je mag ze gebruiken voor je eigen training. Kopieer, deel of verkoop ze niet zonder schriftelijke toestemming.

Jouw inhoud

Wat je in de app schrijft (dagboeknotities, aantekeningen, doelen) is van jou. In versie 1.0 blijven je dagboeknotities op je apparaat en worden ze niet naar ons gestuurd.

7. Disclaimer mentale gezondheid

Basketball Mind is een hulpmiddel voor mentale prestatietraining, geen dienst voor geestelijke gezondheidszorg.

  • De app biedt geen therapie, counseling of klinisch-psychologische zorg.
  • De inhoud is bedoeld om beter te presteren, niet om een aandoening te behandelen.
  • De app houdt je welzijn niet bij en kan niet zien of je het moeilijk hebt.
  • Voel je je slechter door een oefening of andere inhoud, stop dan en praat met iemand die je vertrouwt of met een professional.

De crisisknop in de app en de hulplijnen in sectie 1 zijn altijd beschikbaar.

8. Beperking van aansprakelijkheid

Voor zover de wet dat toestaat:

  • Basketball Mind wordt aangeboden "zoals het is", zonder garantie dat de app altijd zonder onderbreking of fouten werkt, of dat je er bepaalde prestatiedoelen mee haalt.
  • Wij zijn niet aansprakelijk voor indirecte schade of gevolgschade door het gebruik van de app.
  • Wij zijn niet verantwoordelijk voor beslissingen die je neemt op basis van de inhoud van de app.

Niets in deze voorwaarden beperkt aansprakelijkheid die volgens de wet niet beperkt mag worden, zoals aansprakelijkheid voor opzet of grove nalatigheid, en niets beperkt je rechten als consument.

9. Beschikbaarheid en wijzigingen

  • Wij doen ons best om Basketball Mind beschikbaar te houden, maar kunnen niet beloven dat de app altijd werkt. Onderhoud en storingen kunnen tot onderbreking leiden.
  • Wij kunnen functies toevoegen, wijzigen of verwijderen.
  • Wij kunnen deze voorwaarden aanpassen. Wij wijzigen dan de datum bovenaan en melden belangrijke wijzigingen in de app. Ben je het niet eens met nieuwe voorwaarden, dan kun je stoppen met de app en je account verwijderen.

10. Stoppen met gebruik

Door jou

Je kunt altijd stoppen. Om je account te verwijderen ga je in de app naar Profiel → Account verwijderen. Je account en de gegevens daarvan worden direct en definitief van onze server verwijderd, en de gegevens op je apparaat worden gewist. Je kunt ook mailen naar privacy@basketball-mind.com. Zie ons privacybeleid voor de details.

Door ons

Wij kunnen je account blokkeren of sluiten als je deze voorwaarden breekt, als je gebruik de dienst of andere gebruikers in gevaar brengt, of als de wet dat vereist. Waar mogelijk laten wij het je eerst weten.

11. Toepasselijk recht en geschillen

Op deze voorwaarden is Nederlands recht van toepassing. Ben je consument, dan houd je de bescherming van het dwingende consumentenrecht van het land waar je woont.

Heb je een klacht, mail ons dan eerst; wij proberen het samen op te lossen. Geschillen worden voorgelegd aan de bevoegde rechter in Nederland, tenzij de wet je het recht geeft naar een rechter in je eigen woonplaats te gaan.

12. Gedeeltelijke ongeldigheid

Als een deel van deze voorwaarden niet geldig is, blijft de rest gewoon van kracht.
